  1. Suffice to say at times, governement entities have decisions made by people that disregard the law, collective bargaining agreements and employees civil rights. The problem is that the only remedy is found in civil court. Whether it be state or federal. And whatever the outcome, it doesn't matter to the person whom made the decision. They aren't paying out of pocket to violate a person's rights and destroy their lives. Its tax payer money. In cases where the civil charges are shown and proven to be malicous criminal charges should be applied. Then and only then will these pos think twice.


  2. Sqd46 hit on many valid points and I agree with him. Diving is arguably one of the most, if not the most, dangerous facet of our jobs. Going on the theory that all the moons are aligned and this is a save not a rescue and services are turned down for reasons that the Cmdr. is not able to articulate would certainly result in civil and most definitely (state/federal)criminal charges. Personally I can't comprehend how this scenario could possibly come to fruition. With different agencies and checks and balances that SHOULD be in place it is not likely that a critical decision such as this would go un-questioned at the scene. Although it is a simple question we are working in the dark as far as the many other details that have to be known.


  3. Curious at what exactly precipitated the brawl. Like they say..there are three sides to every story. Not that it would excuse an assault.

    That aside, it has always amazed me that reporters will go and put themselves into a threatening situation just to push the envelope as far as they can go. I am surprised that this doesn't happen more often.

  4. If I could only pick one tool for the tour to do forced entries with I would certainly go with a Rabbit Tool. In 7 years of doing Medical/Forced entries it has NEVER failed me-wood or metal. We just bought two spares and I think they ran around $1200.00 each (approx.). When time is of the essence damage takes a back seat and using anything else is too time consuming. The buses down here don't carry them but we also get dispatched on all forced entries so its kind of a moot point with them.

Aside from the other troubles this gentlemen has i.e.-fear of taking orders, and you guys would know the stats better than me, about what percentage of the fire service is directly related to medical calls specifically ALS? We're not talking about changing his job description from FF to hi-wire trapeze artist. Its a very far stretch to say that his job description was arbitrarily changed to such a degree that it altered the specifications of his promise of employment. Even if it was affirmed that his job description was changed I would say the fact that he has a medical condition, albeit related to passing out from needles, it would still fall under fitness for duty (unfit for duty)and preclude him from employment-especially so early in his career. I have been a Union rep. as long as I have been a cop. And just like a good cop has to think like a criminal to be effective, be safe and one step ahead, so goes the same with dealing with management. Rest assured they probably do not want to be married to, what they probably consider, a problem child and the liabilities that go along with it so its easier to cut there loses now. If they give him what he wants without a fight-guess whats gonna happen next time somebody doesn't want to perform a job function etc.? We are kinda working in the dark as far as facts, but based on whats been said here once it was determined that he passes out because of needles, a big can of worms were opened. I have guys seen guys with similar problems, with much time OTJ, get forced out on a disability pension. Unfortunately, IMO-I think unless they (Union/Lawyers) can document that he is being singled out for some reason they are gonna have a tough battle. As far as probation goes, if he had issues while on probation and the Dept. didn't follow up with progressive discipline they missed the boat. FF is such an unpredictable and dangerous job there is not telling when he may be placed into an environment with needle sticks-MVA's, medical calls, traumas. I would be very curious to see exactly what they charged (admin.) him with in order to terminate him.


  6. It should be interesting to see how they rule on this case. There are all sorts of issues from Federal ADA, contractual and rules and regulations etc. that could prove positive and/or negative for his claim. But I would think that management's argument would be largely based on the ff's 'fitness for duty' and 'managerial prerogative' as far as job assignment goes. The big question is...the original job description and how much the job description was altered and does it reasonably deviate from requirements of similar agencies by increasing the level of training and standards . Its certainly going to take some fancy footwork on the part of their Union/lawyers to make the argument. But like always, a lawyer, whom has not a clue about public safety work will make the call. Go figure...


  7. We are about to spec.-out new Thermal Imager(s) for the Truck and Wagons. Looking for a TIC that is user friendly, durable, decent battery life and primarily used for open area perp/actor searches as well as USAR. Any comments on what you may use now, both positive and negative, will be appreciated and helpful in narrowing the search. Good spec.'s are more important than cost at this point.   8. Interesting question - there seem to be two categories used synonymously with LODD

    Death While On Duty - as the case here

    Line of duty death - killed fighting fire, killed by suspect, etc.

    Not an important distinction except to the lawyers and benefits people who will seek to pay out as little as possible to all involved! :(

    Thats a good interpretation. Most agencies and the Politicians that make the decisions would make the appropriate call. Some because its the 'right thing to do' but mostly because of the public relations backlash that would follow in the media if they denied benefits and honors for a person that gave their life for their community.


  9. Agreed. Very proud of my Irish heritage but think that's inappropriate. But given the way our beloved Country is going, someday you may see a ban on displaying the American flag on Public Safety vehicles as they consider it insensitive to immigrants. It would be nice if C3 stepped up there production line as promoted.


  10. We were told that Krammes out in Penn. received the original contract from NYPD of 50 REP's about two years ago. They delivered the first eleven just a little slower than anticipated and the contract then wound up going to Odyssey. I was able to check out one of the first to come from Krammes that was assigned to Truck 4. And IMO the design and construction was incredible. But time will tell. NYPD REP spec's are mind boggling and well done. We referenced them when ordering trucks from Odyssey and outside of the turbo's blowing on all five trucks at least twice, which is Ford's problem, they have been pretty good so far except for some small issues. Didn't you guys say that American LaFrance is Chapter 11 or 13 in regards to Port Auth. ESU?

  11. Can't we all just get along INDEED! This is ridiculous and downright absurd... sad part is this isn't the first time this has happened.

    Of course this is not the first time it has happened and it won't be the last. It wasn't an MVA with entrapment and it was off to the shoulder. The EMT's were off tending to the patient and seems they had it all under control. The ff who was arrested apparently had too much coffee. He couldn't even wait for the truck to come close to a stop (yup you called it). I understand and appreciate the idea of providing an extra layer of protection but you can't tell me that when guys decide to park fire trucks they are always in the right and its done safely. And in this situation and based on what I observed and can't say I disagree. Had the truck parked behind the radio car in the right lane I wouldn't have an issue with the traffic situation. And I also don't beleive that the ff was wishing the Officer a Merry Christmas. So now they can let a judge decide the fate and hopefully next time cooler heads prevail and safety for everyone ( the big picture) rather than ego will set the tone. Just out of curiousity-does anyone know what or if the driver (ff) was issued summonses?

    As for ff's hating cops...thanks for the heads up, but, I keep that in mind while doing car stops for a myriad of reasons.
