    Congratulations to Officer Hess, on receiving this prestigious award from his colleagues, well deserved, I might add.
    Regarding the expected (over)reaction and orchestrated response from the Henry family, que sera sera.
    Let me go way out on a limb, here, if I may... I often wonder...
    if anything would have wound up any differently in regards to this entire incident, if the police officers involved with the shooting , were black? Or the alleged assailant, white?
    I'm going to go out even further... I bet nobody involved in this is going to be having a cold beer with President Obama, anytime soon.

    Yes, but those two examples are very different from widespread investigation/prosecution of police. In the first example, you admit (and seem to consent) to profiling, and in the second, that was an opinion, a far stretch from any official policy or action of the DoJ. So to make a blanket statement that the DoJ is being overly aggressive against law enforcement seems unfounded (just my opinion).

    As far as I am concerned, Aaron SAVED lives that night. What would have happened if DJ Henry drove off and killed one of the hundreds of kids that were running amok through the shopping center? Or an innocent person if he managed to get out on the road? The Henry Family is obviously not seeing the "what COULD have happened"! They could have easily been on the "other side of the fence" and being sued by a family who's loved one was run down by their drunk son - because as we all know, drunk drivers have been known to kill or mame.
    I just hope that Aaron makes a full recovery - I, for one, have missed working with him!!!

    As far as the feds go, they are on a witch hunt in westchester county and will stop at nothing to hang a cop, even if it's under false pretenses... we all remember how the FBI agent that was investigating Det. Quinoy in Sleppy Hollow tampered with evidence to try to get a conviction.
    But no matter what the feds say, it will not change the fact that PO Hess is the Pleasantville PBA's officer of the year !!!

    This is a fine topic, that as far as I have read has not yet been answered. There are separate issues. What does the thoughtful provider do to provide the most help to the most people? And...all else being equal, does the call at hand take precedence over the call pending? It's not being chicken to want to know that.
    Months ago, I was sent out of district for a PIAA for which dispatch had no additional information. Enroute, but also in that district, I came on a motorcycle into a guide rail, the rider unconscious. No fire, police, ems on scene. Dispatch couldn't tell me if they even knew about the motorcycle yet, they knew nothing about the call to which I was assigned, and when I asked if I should remain on scene or continue to the other PIAA the response was 'I can't tell you that, It's your decision.' [i stayed with the motorcycle on the grounds that whatever the other call was, it was going to be hard to top what I was looking at.]
    That said, when, as a single provider, one does not know what units are assigned to either call or the severity, how does one make a good decision? Law should be clear at least on the starting point. Is the duty to act for the assigned call, or is the duty to act for the presenting call? We will hopefully all make the best decisions we can case by case, but we also ought to have a clearer basis from which to make that decision.

    With all due respect, I think you have a grave misunderstanding about the role of an agency officer and the responsibilities of an agency member. It also seems that you view "professional courtesy" as an entitlement. Let me address your comments one at a time...
    First off how do you know the police agencies and/or officers involved in this situation haven't gone to the offending agency in the past? Perhaps this is a pattern of behavior that needs to be resolved officially in the courts.
    The defendant in this case committed 21 violations (or perhaps more) and received 21 summonses. The number of violations is what should be viewed as excessive, not the number of charges filed against him. These summonses were issued in lieu of a custodial arrest so the officers did exercise discretion.
    Agency administrators, be they Chief, Captain, Commissioner, or whatever, are not parents and their members are not children (at least chronologically). There is definitely a time and a place for bringing a wayward child home to mommy or daddy but this is the case of an adult being held responsible for his actions. There's simply no reason for law enforcement to take an offender to his employer to resolve criminal acts (and reckless driving is a crime). That's like saying the State Police should take their findings in the fatal I-95 bus crash to the bus company for resolution. Where's the logic in that?
    I understand where you're coming from about dealing with an agency directly and sometimes that is the right thing to do. I once stopped a vehicle operating at an excessive speed with a blue light and learned that there was no fire, the driver was late for work. He got his speeding ticket and his chief (three towns over) got a phone call about the blue light. Had the guy been running people off the road the chief would have read about the arrest in the newspaper.
    It doesn't matter if it is a chief or member or civilian driving recklessly. They should be and are held responsible for their own actions. This case is noteworthy because it occurred while the offender was exercising the privilege of using red lights and siren. As the driver of any vehicle you're held responsible for the operation of that vehicle.
    It isn't the lights and siren that make the risk greater; it is the driver's tendency to go faster and take more chances while using them. Psychologically it may be a false sense of security or it may be just plain adrenaline. And, highlighting points from other threads, there is a lack of supervision in many volunteer agencies that exacerbates this problem.
    Finally, to receive professional courtesy one must be professional and courteous. This driver was neither. To expect preferential treatment or even infer that it is deserved in a case like this is why we hear stories of people getting tickets despite their membership in a fire or EMS agency. People get courtesy when they deserve it, not when they demand it.

    See how gray this topic is? Even the attorney specializing in this type of law says "I would think". Not black and white, despite the posters here indicating it is. And remember, citing laws and case law from other states is somewhat useless if you are working here in New York. The intricacies of civil (and criminal) law vary greatly from state to state. That even holds true in Federal Court. Caselaw varies greatly between Circuits. So a federal negligence claims in the 9th Circuit (West Coast) may need to meet different standards then say in the 2nd Circuit (NY, Conn., Vt.).

    I recently finished my EMT-B class, and, once I got out into the field and started dealing with real-life situations, I was very surprised about how unprepared I felt. My instructor for the classroom/lecture portion of the class was very knowledgeable and prepared us well to pass the state written exam. (As with anything else, I'm sure the quality varies quite a bit between instructors.) On the other hand, the quality of some of the lab instruction—as well as the amount of time alloted for lab instruction—left a lot to be desired. And it seems like those practical skills learned and practiced in lab—built upon a foundation of knowledge about anatomy and physiology from the classroom portion of the class—are the mark of good BLS.
    From my very limited experience in the field, it seems like adding a greater emphasis on practical skills training might help produce EMT's that provide the higher-quality BLS that the original poster asked about. This poses the problem, though, of creating EMT-B classes that are prohibitively long; I wonder if adding additional hours to the class to accommodate expanded practical skills training might dissuade a lot of people from taking the class altogether. If the length of the EMT-B class was kept the same but time was shifted toward practical skills and away from classroom instruction, I wonder if that might create EMT's who are good with BLS skills but are not sufficiently knowledgeable about the anatomy and physiology behind what they're doing. I guess it's a problem of finding the right balance between lab and classroom instruction.
    Although adding more emphasis on practical skills training might help with improving the quality of EMTs' BLS skills, I was surprised about how little effort a few people in my EMT-B class put forth. You could tell they weren't reading the textbook or practicing the skills on their own. I'm not sure if those people passed the state written and practical exams or not. Although those exams might do a little to help keep people with poor BLS skills from becoming EMT's, I'm sure quite a few people eek by and get their EMT-B certification (they weren't that difficult). I agree with what PFDRes47cue said about "instructors pushing kids through the classes." It might help the quality of BLS that is provided by EMT's if the bar was set a bit higher.

    Generally speaking...
    I'll say this about the issue of laws and the Constitution being thrown around in general and this forum specifically. It is very easy to misinterpret the applicaiton of laws and the bill of rights without formal training and experience working with them and within the criminal justice system. This is why we have lawyers, courts, appeals courts, federal courts, federal appeals courts and the Supreme Court. If it were so clear, there wouldn't be a
    Talking about laws and purported statements of fact concerning what is and isn't legal does suggest a greater knowledge of the subject than is often manifested in posts here.
    There should have been an application to have the suspect's passport surrendered to the court given that she was the subject of a major investigation. This happens often and would haven't be an infringement on anyone's rights. Had she refused, she could have been surveilled, arrested, or otherwise monitored to avoid this extradition nightmare. Her very cooperatirve attorney evidently wasn't quite so cooperative or honorable. Shocking.
