Can NYS PESH cite a department for lack of leadership training and experience of Chief officers?

Hmmmm......Let's see how this is going to pan out........."Fire Service Operations Leadership with out any current or relevant training"

 

Eitherway, it's not good.  Just read some NIOSH LODD reports to see how its turned out in the past.

The employer shall provide training and education for all fire brigade members commensurate with those duties and functions that fire brigade members are expected to perform. Such training and education shall be provided to fire brigade members before they perform fire brigade emergency activities. Fire brigade leaders and training instructors shall be provided with training and education which is more comprehensive than that provided to the general membership of the fire brigade.

1920.120 (q)(6)(v) Hazwoper Standard

Requires additional training for any "on Scene Incident commander" beyond hazmat ops.  That is why you have the HazMat Incident Commander class.

NYS PESH came out last year at several fire service conferences to discuss with "Best Practices" document developed by OFPC, PESH and FASNY/NYSAFC representatives.  In that document it is stated that higher level of training is needed by line/chief officers including the job objectives contained in Fire Officer 1 as well as other training including Firefighter 2.

What happens in a combination department, that has career leadership for the career guys, and volunteer leadership for the volunteers? Who is ultimately responsible in the eyes of PESH?

The district or municipality in most cases.

So, what is the penalty? Do they remove the Chiefs? What happens if there is no one qualified to replace them? Or do they issue an order for them to get more training? And what would happen in the meantime?

Ah, yes... when this discussion with commissioners turns into "we'll just pay the fine" and then ultimately, when you mention that you can be sued if you screw it up...
