    With regard to the search and seizure issues raised:
    Was the gun on his person or in the car? If he was arrested for Aggravated Unlicensed Operation (or any charge), he would have been searched proir to being secured in the troopers car and most likely the firearm seized for officer’s safety. In clearing the weapon, the amount of rounds would have been observed. Any contraband found on his person would be admissible. The courts have held that LEOs may conduct a search of the “immediate area of the subjects control” for officers safety. Again no search and seizure issues. They can also ask he exit the vehicle and the officers perform a pat down for officer’s safety if they feel it is warranted under the circumstances. If the subject was not able to turn the vehicle over to a licensed driver, the vehicle was most likely impounded and towed. Prior to towing, many departments require an inventory search of the vehicle’s contents in order to prevent lawsuits for “missing items”. Providing that it is done uniformly on all impounds, it’s been upheld as a reasonable action. Any item found in the vehicle (with certain exceptions) is admissible in court. Any item in “plain view” is also admissible. With the amount of information provided in the story, it seems that the weapon would have been lawfully discovered under a number of scenarios.
    Given the limited course of events identified in the story, I am glad that the DA chose not to prosecute for the two extra bullets. I am hoping that this action sounds loud and clear in Albany. As many of you have seen, I feel that the law and the politicians that enacted this piece of trash legislation belong in the trash.

    To all the FDNY members on this site- you don't know how lucky we are/were, with the FDNY shops and radio repair,etc. The field crew (on-duty FDNY mechanics who respond to qtrs for app repairs) has always been top-notch. They try to repair whatever they can, to prevent you having to get a spare and change over the rig (PAIN in the ASS, esp. for the engine co., with all the hose to change over.The radio repair guys come to qtrs to fix any problems with the mobile data terminal (MDT) or siren or app radio; the tire repair guys respond to wherever you end up with a flat, and throw on a new tire. I dare say that most career depts. on this site aren't that lucky?!
    I recall many years ago, when I "vested/retired" from FDNY and got a job as a shift commander in a west coast Florida county FD. The rigs were in fairly poor condition, and anytime there was a problem with one of the pieces, we had to tow it/drive it to the county repair shop, where they repaired all county vehicles- there was no specific "fire apparatus mechanic". Needless to say, the rigs were not always repaired correctly. After 8 months there, I was lucky enough to get back on FDNY. It was quite an experience,looking back. One of the better firefighters on my shift (who grew up on LI) asked me one day-"Cap, why did you leave the "Yankees" to come play with the "Port charlotte RedHens"? I asked myself that question every day until I got back to the Big Apple. Nothing beats playing with the Big Guys!

    Almost, huh? I have nothing against the officers who do get assigned to the boat when they get assigned to the boat. They all do a very good job within the limits of the department.
    How many boats does the county have? 3? 4? But they only staff one for the summer , right? And only on the Hudson. So the left side of the map gets a dedicated presence from the County but the right side of the map gets none. Sorry but that's like saying you only patrol the northbound side of the parkway and not the southbound. Still not your fault, it's mismanagement.
    There was a time that the county had the stakeholders gather to decide how grant money for Westchester County would be spent. There were debates and some huge disagreements (always bring popcorn for the show) but in the end the best projects got funding.
    Now some bosses have their very own tahoes and we have a fleet of boats that the county won't staff.
    Can you honestly tell me that another boat was the best use of those funds? Did anyone ask what other projects might be more important then yet another boat for the Hudson?
    Nothing personal, nothing personal at all.

    Last week, RWC130 hooked me up with a visit to the FDNY Shops. The building is massive, it makes the tillers parked in there looked small. Hard to really appreciate how big it is in a photo. The construction is also pretty cool, the roof is bowed, but concrete with no columns. The foundation is designed to support the bowed concrete roof. I was given an article on the construction, and it was very modern and progressive building at the time (1940's). It was a "Z-D" system designed by the architects. And the shops are pretty clean, well kept, and well equipped compared to other repair facilities I've seen. It also it very bright, it has skylights and, when it was built, had the largest fluorescent light system in NYC.
    Anyways, the shop is massive, and can fix just about anything. It is an amazing place, not just the apparatus, but the shops and mechanics and all the tools and equipment they have. It was also neat to see all the apparatus in different states of repair, and being able to compare the brand new Ferrara and Seagrave ladders to the older ones. FDNY apparatus is increasingly very progressive and has a lot of user friendly ideas and capabilities.
    Here are some photos.Sorry about the quality, I'm not really good at shooting indoors, especially with the type of lights they had there and the way everything was positioned. Also, I'm more interested in the specs then the just the apparatus.

    Great, just what Orange County needs..... another department. We should be thinking about how to provide more streamline and consistent responses instead of forming another kingdom. Lets address the issues at hand (which is witnessed everyday lately) such as responding for calls of service in a timely manner with a crew (not 1 or 2 guys). Why do departments (usually the same departments everyday) continually not crew up for a call, yet no plans seem to ever be put in place to correct the problem? Last week there was a department who could not even get out for a structure fire, mutual aid departments who were sent (only after the first department could not crew) had to respond and extinguish the fire (good thing fire only doubles in size every 30-60 seconds).
    This is the last thing Orange County needs, we should be working together towards consolidation and not duplicating resources.

    Officer Ivan Marcano of the NYPD's Transit District 12 was promoted to Detective this morning in a bedside promotion ceremony with Mayor Bloomberg and Police Commissioner Ray Kelly. PO Marcano was off duty when he observed 3 males robbing a man on street an took action. Officer Marcano was shot once in the chest, but was still able to pursue the perpetrators, firing his weapon weak handed, while his strong hand was applying pressure to his wounds. I work in the same command with Ivan, he is resting comfortably in the hospital, and is expected to make a complete recovery. He should be released from the hospital shortly. Watching the video and hearing him talk about the action first hand is incredible. You can see in the video how he reverted to the training we have received to take cover, change positions if needed, and never give up the fight even if injured. Great Job Ivan, I am sure the Firearms and Tactics Section will use your story and video to help train future officers.

    SP Aviation is relatively unaffected. Their primary mission remains law enforcement. As for a new partnership, I'm not even sure one is needed. With the number of air assets available to the region, coverage seems more than adequate. Couple that with the new trauma center planned in Orange County, I think MLSS made a smart, business oriented decision.

    Your 1st statement is 100% on the money. And clearly this is what is happening here now.
    It may be smaller in area, but it does have 3x the population. And I was using it to compare regions, not a state wide or national service. I spent time riding with them and in some ways their traditions are stronger than ours. It was easier to accomplish because of their organization, because they already had done it and because there was a lot less "turf".

    On April 1st 2013, Scotland's 8 regional Fire & Rescue services were merged into a single national department. The 8 regional police services were also merged into a single national service.
    The 8 regions were originally made up of many smaller depts. but during and after world war IIthey were merged.

    Wow, 8 depts are too many for an entire nation so they are merging them into 1. We have 59 in just our county and they all believe that their community would not survive without them. Infact we have whole towns with 8 departments. What was most interesting is their reasoning for the merge, they wanted to save money, but most important they did not want to reduce services. All over America we see depts cutting staffing, cutting companies, cutting houses, cutting salaries and the number of volunteers dropping, but still no one is willing to merge to make sure the services delivered in the field remain strong? So this merger will save enough money to maintain every company, every station and the minimum manning on an engine will remain at 6 (1 officer, 1 driver & 4 firefighters).We really need to rethink how we do this and why we do this.

    You can always call anyone about anything. That would make this website, as well as thousands of others, obsolete. I initially asked if Hartsdale was still borrowing MVFD TL-3.....it's a yes or no question.
    My secondary question is that, if Hartsdale ever trades it in for a new Ladder, who gets the funds, Hartsdale or Mount Vernon?
    I don't understand why this is such a big deal.

    Description: Kitchen Fire in an OMD
    1412hrs-Base-5 alerting Vails Gate; respond to South Gate Village, building 2300, apartment 2305 for the reported structure fire.
    E481 called on responding within minutes of dispatch. Base-5 advised that PD was requesting the FD to expedite due to reports of a child trapped.
    Car-2 arrived on scene, established Command and advised of smoke showing from an apartment on the #2 floor. Car-2 then advised that all occupants were out and accounted for.
    E481 was directed to grab a hydrant and lay in. It's crew led off with a 1 3/4" line to the #2 floor and made entry. Members quickly located the fire in the kitchen area and made a quick knock-down.
    T482's crew arrived and started opening up and checking for extension which was (-).
    Companies then began to take up and return to service.
